MS Lawyers Succeed in Freezing $6 Million in Assets in West Virginia
What the Case Involved:
Marks & Sokolov attorneys filed a RICO (Racketeer Influenced and Corrupt Organizations Act) claim in Federal court in West Virginia against foreign defendants who maintained assets in the West Virginia Bankruptcy Court. Those assets were scheduled to be paid out of a bankruptcy proceeding. If this were to occur, the defendants may not be able to pay any judgment rendered in the case.

Result:
Using a West Virginia pre-judgment arrest statute, Marks & Sokolov attorneys obtained a preliminary injunction seizing over $6 million in assets. With the injunction in place, the assets will not be distributed to the defendant. Instead they will remain in the bankruptcy court and out of the defendant’s reach while Marks & Sokolov attorneys continue to litigate the matter.
